Who We Are

Welcome to Gibson Studio. These Terms of Service (“Terms“) govern your access to and use of the website www.gibsonstudio.it and any purchase made through it (together, the “Services“). By browsing our site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Our Products

Gibson Studio sells original apparel and accessories (“Products“). Products are manufactured on a on-demand basis: each item is produced individually after you place an order by our fulfillment partner and shipped directly to you. Nothing is held in pre-made stock, which is why production and delivery estimates work differently than for off-the-shelf retail.

We take reasonable care to display colors, sizes, and materials accurately, but slight variations between what you see on screen and the finished product can occur due to monitor settings, fabric batches, and the printing process itself. This does not, on its own, make an item defective.

Accounts & Orders

You must be at least 18 years old, or be placing an order with the consent and involvement of a parent or legal guardian, to use the Services.

When you place an order you agree to:

• Provide accurate, current, and complete information, including your billing and shipping address
• Use the Services only for lawful purposes and in compliance with these Terms and applicable law
• Not reproduce, resell, scrape, or otherwise exploit any part of the Services or our Products without our prior written permission

We reserve the right to refuse or cancel any order, at any stage, for reasons including suspected fraud, pricing or listing errors, or unavailability of materials, in which case you will be refunded in full for that order.

Prices & Payment

All prices are displayed in Euros (€) and, where applicable under Italian law, are inclusive of VAT. Shipping costs are calculated separately and shown at checkout before you confirm your order.

We reserve the right to change prices at any time. The price charged is always the one displayed at the moment you complete checkout. Payments are processed securely through our payment providers using the methods shown at checkout (credit/debit card and any other options offered). Gibson Studio does not store your full card details.

A contract of sale is formed once we send you an order confirmation email and upon sending constitutes acceptance of your order.

Shipping & Delivery

Production and delivery timeframes, carriers, tracking, and customs information are set out in full in our Shipping Policy, which forms part of these Terms. You are responsible for the accuracy of the shipping address you provide. Gibson Studio is not liable for delays or non-delivery caused by incorrect information supplied at checkout.

Right of Withdrawal

If you are a consumer buying for personal use and residing in the EU, you generally have a legal right of withdrawal under the Italian Consumer Code (D.Lgs. 206/2005, implementing EU Directive 2011/83), allowing you to cancel a purchase within 14 days of delivery without giving a reason.

Important exception for made-to-order goods: because our Products are printed and manufactured specifically for you after you order (Art. 59, letter c, Codice del Consumo – goods made to the consumer’s specifications or clearly personalised), the legal right of withdrawal generally does not apply to custom-printed items. This is a standard, lawful exception for on-demand goods, not a restriction we impose beyond what the law allows.

Where an item is not personalised (for example, blank stock merchandise, if any), the standard 14-day withdrawal right applies in full. See our Return Policy for exact conditions, how to exercise this right, and how our voluntary 30-day return window works alongside it.

Returns, Refunds & Legal Warranty

Independently of the right of withdrawal above, all Products benefit from the mandatory legal warranty of conformity (garanzia legale di conformità) under Articles 128–135 of the Codice del Consumo – 24 months from delivery for physical defects that existed at the time of delivery. This warranty cannot be excluded or reduced by us.

Intellectual Property

All content on the Services – including designs, artwork, logos, text, photography, and site code – is owned by Gibson Studio or its licensors and is protected by Italian and international copyright, trademark, and design law. You may not copy, reproduce, distribute, or create derivative works from any of it without our prior written consent.

If you submit content to us (for example, a product review or a photo tagged to us on social media), you grant Gibson Studio a non-exclusive, royalty-free, worldwide licence to display and use that content in connection with promoting our Products, and you confirm you have the rights to grant that licence.

Liability & Force Majeure

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be limited or excluded under Italian law, including your mandatory rights as a consumer.

Subject to the above, to the extent permitted by law, Gibson Studio is not liable for indirect or consequential losses (such as loss of profit or data) arising from your use of the Services.

We are not responsible for delays or failures in performance caused by events outside our reasonable control, including acts of God, war, strikes, carrier disruption, or failures of third-party providers such as our fulfillment center or our payment processor.

Governing Law & Disputes

These Terms are governed by Italian law. If you are a consumer habitually resident in another EU country, this choice of law does not deprive you of the mandatory consumer protections that country’s law would otherwise give you.

Any dispute will fall under the jurisdiction of the court of the place where you, as a consumer, reside or are domiciled (the mandatory “foro del consumatore” under Art. 66-bis of the Codice del Consumo), unless otherwise required by law.

The European Commission’s former Online Dispute Resolution platform was permanently discontinued on 20 July 2025. You can find a current list of certified out-of-court dispute resolution bodies at the European Commission’s Consumer Redress portal, or through your local Chamber of Commerce mediation service in Italy.

Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in our services or the law. The “Last Updated” date at the top of this page will always reflect the current version. Material changes will not affect orders placed before the change took effect.
